Fond Portraits is a trading name of Ali Hyder, 11 Hoadly Road, London SW16 1AE, fondportraits@gmail.com. Ali Hyder is the controller of your personal information.
What we collect
- Your order details: name, email, delivery address, and what you bought.
- The photo of your pet that you upload, and the name you add (if any).
- Messages you send us.
- Information from your device when you visit our shop, such as pages viewed, collected by Shopify and by any cookies you accept (see the cookie banner).
Phone photos can carry hidden information, such as where the photo was taken. We remove that information when we receive your photo.
Why we use it, and our legal reasons
- To take payment, make, check, print, deliver and support your order, including any reprint. We need to do this to carry out our contract with you.
- To check that a photo can be used. If a photo shows a person, or something such as a house number, we use it only to check the photo and ask you for another one. Our legal reason is our legitimate interest in checking orders before we make them.
- To keep order and tax records (a legal obligation). These records don't include your photo or the artwork.
- To send you marketing emails, only if you opted in (your consent). You can unsubscribe at any time.
- To show your finished portrait (never your original photo) on our website or social media, only if you gave separate permission (your consent). You can withdraw that at any time by emailing us.
How we handle your photo
- We create the artwork with AI image tools. An AI assistant helps us check your photo and the artwork against a written checklist, and a person looks at every artwork before it's printed.
- We don't use face recognition, and we don't use your photo to identify anyone.
- We never send your photo or the artwork to advertising platforms, and we don't sell it.
- We don't use your photo in our marketing.
AI and training
We don't use your photo to train AI. Our AI image service, fal, is set up so that it doesn't store your photo after making the artwork and doesn't use it to train AI. The AI model fal runs for us is made by OpenAI. Our service providers may use anonymised, combined usage data, which doesn't show your photo, to run and improve their services.
Who receives your information
- Shopify, which runs our shop, takes payment and stores your upload with your order.
- fal (Features & Labels Inc., USA), our AI image service, which runs an AI model made by OpenAI to create the artwork.
- Anthropic, which makes Claude, the AI assistant that helps us check photos and artwork.
- Our print partner Gelato (UK production), which prints and packs your canvas. It receives the artwork, your name and your delivery address.
- The delivery company (for example Evri or Royal Mail), which receives your name and delivery address and uses them under its own privacy notice.
Apart from the delivery company, these providers act on our instructions under data protection terms.
Outside the UK
Some of these providers are in the USA or other countries. Where your information leaves the UK, it's protected by the safeguards UK data protection law requires, such as the UK International Data Transfer Agreement or the UK-US Data Bridge.
How long we keep it
- Your photo and the artwork: we delete photos after your order is complete where our platform allows. Unused versions of the artwork are deleted as soon as the final artwork is chosen. Copies held by Shopify or Gelato with your order are kept under their own data rules.
- The final print file: kept for up to 6 months after delivery, in case you need a reprint or make a complaint, then deleted.
- Your order record (without your photo or the artwork): kept for 6 years, for tax.
- A portrait you allowed us to show: until you withdraw your permission.
Your rights and complaints
You can ask for a copy of your information, or ask us to correct or delete it, or object to how we use it, by emailing fondportraits@gmail.com. We'll reply within 1 month. If you complain to us about how we've used your information, we'll acknowledge your complaint within 30 days and tell you what we've done. You can also complain to the Information Commissioner's Office (ico.org.uk, 0303 123 1113).
